1. Application of These Terms and Conditions

These Terms and Conditions govern the relationship between the Client and Migration Venture Africa and apply in the following situations:

  • When you book a tour directly with us;
  • When you book a tour through our authorized partners or sales representatives;
  • When you confirm a booking with us, either directly or through a third party such as a travel agency or marketplace.

By booking a tour with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

These Terms and Conditions define the rights and responsibilities of both the Client and the Company in relation to all tours and travel services provided in Tanzania.

2. Our Warranties and Representations

Migration Venture Africa confirms that:

  • We hold all necessary licenses and permits required to organize and operate Kilimanjaro trekking expeditions, wildlife safaris, and other tourism activities in the United Republic of Tanzania.
  • We have extensive experience in organizing travel arrangements for visitors to Tanzania.
  • Our Kilimanjaro guides, safari driver-guides, and travel consultants are professionally trained and experienced in their respective fields.
  • All information used in our marketing and promotional materials is accurate and truthful. We do not intentionally exaggerate or misrepresent our services.
  • We operate as a tour operator and directly manage our tours. Third-party services are limited to accommodation providers, airlines, and other external suppliers where applicable.
  • We are committed to responsible tourism, environmental conservation, and supporting local communities in Tanzania through sustainable tourism practices and fair employment.

3. Treatment of Personal Information

To organize your tour arrangements, we may require personal information, including your full name, nationality, Passport details, Age, Dietary requirements, and Relevant medical information.

This information may be shared only with national park authorities, accommodation providers, airlines, or other relevant service providers, as necessary, for operational purposes related to your tour.

We are committed to handling your personal information responsibly and confidentially.

4. Communications and Correspondence

Official communication channels of Migration Venture Africa include:

  • Email addresses using the domain: @migrationventureafrica.com
  • Phone numbers and WhatsApp contacts listed on our official website
  • Website live chat and contact forms

Clients are advised to communicate only through our official channels to avoid fraud or impersonation by unauthorized third parties.

5. Booking and Payment Process

The booking process begins once you contact us by email, phone, WhatsApp, or through our website. A travel consultant will assist you with planning and organizing your tour.

Once the itinerary and arrangements are confirmed, an invoice will be issued for payment.

Booking Confirmation

Your booking will be confirmed once the required deposit payment has been received in our account. Confirmation will be communicated by your designated travel consultant.

Final Payment

Unless otherwise agreed in writing, full payment for all tours must be completed no later than 14 days before the tour start date.

Failure to make payments on time may result in cancellation of the booking, and cancellation charges may apply.

Transaction Charges

  • All bank transfer fees must be covered by the Client.
  • Credit card payments may be subject to a 3.5% surcharge.
  • Any unpaid balance resulting from transaction deductions shall be payable upon arrival in Tanzania.

6. Participation of Minors

  • Clients must be at least 16 years old to independently book a tour with us.
  • Bookings for minors must be made by a parent, legal guardian, or authorized custodian.
  • Minors must always be accompanied and supervised by an adult during the tour.
  • The accompanying adult is fully responsible for the minor’s conduct, travel documents, permits, and legal travel requirements.

Migration Venture Africa does not provide childcare or chaperone services.

7. Third-Party Bookings

If a booking is made by a travel agent, tour leader, or other representative on behalf of additional participants, that person shall act as the primary contact and shall be responsible for:

  • Informing all participants about these Terms and Conditions;
  • Providing accurate participant information;
  • Making payments on time;
  • Communicating itinerary changes or updates to all participants.

If these responsibilities cannot be accepted, each participant must communicate and book individually.

8. Prices

Once your booking is confirmed, tour prices shall remain unchanged except in cases where government taxes, park fees, concession fees, or other tourism-related charges are increased by Tanzanian authorities.

In such cases, clients will have the option to:

  • Accept the revised price and pay the difference; or
  • Cancel the tour according to the applicable cancellation policy.

9. Changes to the Itinerary

Changes Requested by the Client

Clients may request itinerary changes. If the changes result in additional costs, such costs shall be paid by the Client.

No refunds will be issued for:

  • Missed services,
  • Unused accommodations,
  • Missed meals,
  • Voluntary withdrawal from the tour.

Changes by the Company

We reserve the right to make reasonable itinerary adjustments due to weather conditions, road accessibility, safety concerns, operational requirements, or circumstances beyond our control.

Whenever possible, clients will be informed promptly.

10. Changes to Travel Dates

Requests to change travel dates must be submitted at least 60 days before the original departure date.

  • New travel dates must fall within one year of the original booking date.
  • Changes are subject to availability and supplier policies.
  • Additional costs resulting from airline penalties, seasonal accommodation rates, or supplier charges must be covered by the Client.

11. Cancellation Policy

Cancellation by the Client

Cancellation of booking or failure to join a tour will result in retention of funds by Migration Venture Africa as described below:

  • Upon receipt of written cancellation by any member of the tour indicated on this reservation 30 days or longer before departure, 20% of the reservation of the cancelling party will be retained by Migration Venture Africa, and the balance of the package price will be refunded.
  • If a cancellation is received at least 14 days and up to 29 days before departure, 50% of the package price will be retained by Migration Venture Africa.
  • If a cancellation is received less than 14 days before departure, 100% of the total package price will be retained by Migration Venture Africa, and all outstanding payments will become payable immediately.
  • Should the cancelling party be able to find a replacement for themselves no less than 14 days before departure, and the replacement completes this booking form individually, no retention of funds will take place.  However, should no replacement be found by 14 days before departure, a 100% cancellation penalty will apply to the cancelling party.
  • Migration Venture Africa and its agents reserve the right to terminate, at their discretion and with immediate effect, the participation of any person on the tour.

Please note that some hotels, lodges, airlines, and third-party suppliers may impose higher cancellation penalties. Any additional non-refundable charges and bank transaction fees shall be deducted from the refund amount.

Refund Processing Fee:

  • While processing a refund, a 3% credit card fee is charged to the client’s Visa, AMEX, or MasterCard.
  • When a refund is processed using a Bank Wire payment, bank charges apply.

Cancellation by the Company

In the unlikely event that Migration Venture Africa cancels a tour for reasons within our control, clients will receive a full refund of all payments made to us.

12. Accommodation

Hotel Accommodation

Accommodation arrangements depend on the selected travel package and room occupancy preferences.

Single supplements may apply for clients requesting private rooms.

If a listed hotel becomes unavailable, we reserve the right to provide a similar alternative accommodation of equivalent standard.

Mountain Accommodation

Kilimanjaro climbing packages include shared tent accommodation unless otherwise arranged.

Single-tent accommodation may be available at an additional cost, except on routes where park regulations prohibit it.

13. Travel Insurance

Travel insurance is mandatory for all clients participating in our tours.

Your insurance policy should include coverage for:

  • Medical emergencies,
  • Emergency evacuation,
  • Trip cancellation,
  • Travel delays,
  • Personal injury,
  • Repatriation.

For Kilimanjaro climbs, insurance must specifically cover high-altitude trekking up to 6,000 meters and helicopter evacuation.

Failure to provide adequate insurance may result in refusal to participate in the tour without refund.

14. Vaccinations and Medical Advice

We provide only general travel health information.

Clients are responsible for consulting a licensed medical professional regarding recommended vaccinations, medications, and health precautions before traveling to Tanzania.

15. Equipment and Gear for Kilimanjaro Climbs

Personal climbing gear is not included unless specifically stated in the package.

Clients are responsible for bringing suitable personal equipment. Equipment rental services may be available at an additional cost.

Our team reserves the right to inspect climbing equipment before the expedition begins to ensure safety standards are met.

16. Luggage and Valuables

We are not responsible for luggage lost, delayed, or damaged by airlines or third-party transportation providers.

Clients are responsible for safeguarding their personal belongings, including valuables, money, electronics, and travel documents.

Where requested, valuables may be stored securely in our company safe at the Client’s own risk and subject to agreement.

17. Force Majeure

Migration Venture Africa shall not be held liable for delays, cancellations, losses, injuries, or failure to perform obligations resulting from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters,
  • Extreme weather,
  • Government actions,
  • Political unrest,
  • Wars,
  • Strikes,
  • Pandemics,
  • Mechanical breakdowns,
  • Transportation disruptions,
  • Civil disturbances.

18. Applicable Law

These Terms and Conditions shall be governed and interpreted in accordance with the laws of the United Republic of Tanzania.
